Affiliate Program Agreement
These terms govern participation in the ListBetter Affiliate Program. Please read carefully before enrolling.
Earn commissions by referring property sellers to ListBetter.
Up to $500 per successful sale — Tiered based on the final sale price, paid after settlement.
14-day hold — Then bank transfer (minimum payout $50).
No self-referrals — Strict fraud prevention enforced.
You remain independent — You are responsible for your own marketing and compliance.
Governed by Queensland law.
By enrolling in the ListBetter Affiliate Program, you agree to these terms. If you do not agree, you must not participate.
Program Overview
The ListBetter Affiliate Program allows approved participants to earn commissions by referring property sellers to the platform.
A referral qualifies for commission only when:
The referred seller submits a property through ListBetter
An agent wins the listing through the platform
The property successfully sells and settlement is completed
Commissions are not earned on sign-ups alone, property submissions without a win, or deals that do not settle.
Commission Structure
Commissions are tiered based on the final sale price of the property and paid after settlement:
Under $500,000 — $300
$500,000 – $999,999 — $400
$1,000,000 – $1,999,999 — $450
$2,000,000 and above — $500
ListBetter may update commission tiers with notice. You will be paid based on the tier in effect at the time of settlement.
Payment Terms
All commissions are subject to a 14-day hold period from the date settlement is confirmed. This allows time for fraud checks and dispute resolution.
Minimum payout: $50 AUD (after the hold period).
Payment method: Bank transfer to an Australian bank account in your name or registered business name.
ABN requirement: If your total earnings exceed $1,000 AUD in a financial year, you must provide a valid Australian Business Number (ABN). Without an ABN, ListBetter must withhold 47% tax under ATO rules.
GST: If you are registered for GST, you must advise us. GST will be added where applicable.
You are responsible for providing accurate bank details and tax information. Payments are made via EFT after the hold period.
Clawback Policy
ListBetter may reverse (clawback) any paid or credited commission if:
Settlement falls through or is disputed
The referral is found to be fraudulent or in breach of these terms
The referred seller’s account is terminated for violations
A chargeback or refund occurs on any related transaction
Clawbacks will be deducted from your current balance. If insufficient, the amount may be deducted from future earnings or invoiced to you.
Prohibited Activities
The following are strictly prohibited and may result in immediate termination and forfeiture of unpaid commissions:
Self-referrals — Referring yourself, immediate family, or accounts you control
Misleading marketing — Making false or exaggerated claims about ListBetter
Spam — Unsolicited emails, SMS, or messages
Trademark abuse — Bidding on “ListBetter” or similar terms in paid ads without approval
Incentivised sign-ups — Offering cash, gifts, or rewards for signing up
Fake accounts or submissions — Creating or encouraging fraudulent activity
Cookie stuffing or other automated manipulation of referrals
Fraud Prevention
ListBetter uses fraud detection tools including IP tracking, device fingerprinting, referral velocity checks, and pattern analysis. We reserve the sole discretion to approve, hold, or reject any referral suspected of fraud.
Termination
Either party may terminate this Agreement at any time, with or without notice.
Upon termination:
Your affiliate links will be deactivated
You must stop using ListBetter marketing materials
Qualified commissions (already settled) will still be paid after the hold period
Unqualified or disputed referrals will not earn commission
ListBetter may immediately terminate for breaches, with forfeiture of unpaid commissions
Certain obligations (including clawback, IP, confidentiality, and indemnity) survive termination.
Intellectual Property & Platform Misuse
All platform content, technology, processes, AI systems, workflows, and marketing materials are owned by or licensed exclusively to ListBetter Pty Ltd.
You are granted a limited, non-exclusive, revocable licence to use approved marketing materials and logos solely to promote the affiliate program. You must not modify logos, imply official endorsement, or register domains containing “listbetter” or similar terms.
In addition to the intellectual property protections in these Terms, you are also bound by the Platform Terms of Use.
You must not, directly or indirectly:
Copy, replicate, recreate, or rebuild any platform features, workflows, logic, or automations
Create derivative works (including “inspired by” versions)
Use the platform or knowledge gained to build a competing service
Scrape, extract, or export platform data
Use the platform to train AI or create competing systems
These obligations survive termination. Breaches may result in immediate termination, forfeiture of commissions, and enforcement action including liquidated damages of AUD $5,000 per breach (which the parties agree is a genuine pre-estimate of the loss ListBetter would suffer from such a breach, including development costs, lost revenue opportunities, and brand damage which are difficult to quantify precisely), plus full indemnity for legal costs.
Confidentiality
You agree to keep confidential all non-public information about commission rates, performance data, referral mechanics, and program details. You must not disclose this information to third parties without our prior written consent.
Liability & Indemnity
You are an independent contractor, not an employee, agent, or partner of ListBetter. You are solely responsible for your marketing activities, taxes, insurance, and compliance with all laws.
You agree to indemnify and hold harmless ListBetter, its directors, employees, and affiliates from any claims, losses, damages, or expenses (including legal costs) arising from:
Your breach of these terms
Your marketing or referral activities
Any inaccurate or misleading statements you make
To the maximum extent permitted by law, ListBetter’s total liability under this Agreement is limited to the total commissions paid to you in the 12 months preceding any claim. We are not liable for indirect, consequential, or punitive damages.
Governing Law & Changes
This Agreement is governed by the laws of Queensland, Australia. Any disputes must be brought exclusively in the courts of Queensland.
ListBetter may update these terms from time to time. Continued participation after changes constitutes acceptance. Material changes will be notified where reasonably practicable.
This Agreement, together with the ListBetter Platform Terms of Use and Privacy Policy, forms the entire agreement between the parties.
