Acceptance of Terms
By accessing and using the ListBetter website and services ("Service"), you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services.
Services Description
Offering tools for Sellers to compare agent proposals, fees, and marketing strategies.
Providing comparative data on real estate agents based on historical performance.
Facilitating the collection of proposals from agents for specific properties.
Eligibility
By submitting a property for comparison, you declare that you are the legal owner of the property or have direct authorization from the owner to act on their behalf regarding the potential sale of the property.
User Obligations
As a user of ListBetter, you agree to:
Promptly update the registration data and any other information you provide to ListBetter to keep it accurate, current, and complete.
Maintain the security of your password and identification if you create an account.
Provide accurate, current, and complete information about yourself and your property as prompted by the Service's registration forms.
Not use the Service for any illegal or unauthorized purpose.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without express written permission by us.
Indemnity
You agree to indemnify and hold harmless ListBetter, its directors, employees, and affiliates from any claims, losses, damages, or expenses (including legal costs) arising from:
Your breach of these Terms
Any inaccurate or misleading information you provide
Any claim that you do not own or have authority over the property submitted
Intellectual Property
All content, branding, design, software, processes, and materials on the ListBetter platform are owned by or licensed to ListBetter Pty Ltd.
You are granted a limited, non-exclusive, revocable licence to use the platform solely for its intended purpose.
Privacy Policy
When you submit a request to compare agents, you explicitly consent to ListBetter sharing your property details with a select group of real estate agents for the purpose of generating proposals. Your personal contact information is only shared with agents you explicitly choose to shortlist or contact.
Your privacy is important to us. ListBetter's Privacy Policy is hereby incorporated into these Terms of Service by reference. Please read the Privacy Policy carefully for information relating to our collection, use, and disclosure of your personal information.
Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded. Where a law implies a condition, warranty, or guarantee that cannot be excluded, our liability is limited to the maximum extent permitted by law.
Limitation of Liability
ListBetter makes no warranty that (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations.
Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
