Partner Services Agreement
These terms govern property service providers listed on the ListBetter platform. Please read carefully before applying.
ListBetter connects professional service providers (conveyancers, mortgage brokers, building inspectors, property stylists and others) with property sellers on our platform.
ABN and insurance required — Valid ABN and minimum $1M professional indemnity insurance mandatory.
Pay-per-lead model — You pay a lead fee when a qualified lead is assigned.
24-hour response — Must respond to leads promptly and professionally.
No circumvention — Do not bypass the platform to avoid fees.
Governed by Queensland law.
By registering as a ListBetter Partner, you agree to these terms. If you do not agree, you must not participate.
Program Overview
This Partner Services Agreement governs your participation in the ListBetter Partner Portal. As a Partner, you provide professional services to property sellers referred through the ListBetter platform, including (but not limited to) conveyancing, mortgage broking, building and pest inspections, and property styling.
ListBetter acts solely as a technology platform that connects sellers with service providers. We do not provide the professional services ourselves and are not a party to any agreement between you and a referred seller.
Eligibility Requirements
To become and remain a Partner, you must:
Hold a valid Australian Business Number (ABN)
Maintain all required professional licences and registrations for your service category
Carry current professional indemnity insurance of at least $1,000,000 per claim and public liability insurance of at least $10,000,000
Accurately disclose your GST registration status
ListBetter may request proof of insurance or licences at any time. Failure to maintain these requirements may result in immediate suspension or termination.
Lead Generation & Fees
ListBetter provides qualified leads from sellers who have expressed interest in your service category. You pay a lead fee when a lead is assigned to you. Current lead fees are:
Conveyancing / Solicitor — $45 per lead
Mortgage Broker — $65 per lead
Building & Pest Inspection — $35 per lead
Property Styling — $40 per lead
Removalist Services — $25 per lead
Professional Cleaning — $20 per lead
ListBetter may update lead fees with 30 days’ notice. Lead quality is not guaranteed, and you are responsible for converting leads into clients.
Payments are processed via your nominated card or payment method.
Failed payments may result in suspension of lead delivery.
Non-Circumvention
You must not circumvent the ListBetter platform to avoid paying lead fees.
This includes:
Contacting referred sellers outside the platform to bypass fees
Encouraging sellers to cancel their ListBetter engagement to work directly with you
Using lead information for purposes other than the requested service
Re-referring sellers to non-registered service providers
Breaches will result in immediate termination, forfeiture of any pending amounts, and potential legal action.
Service Standards
You must:
Respond to all leads within 24 hours of assignment
Provide accurate quotes, transparent pricing, and professional service
Complete work within agreed timeframes
Maintain confidentiality of seller information
Comply with all applicable laws and industry regulations
Consistent negative feedback or complaints may lead to suspension or termination pending investigation.
Tax Compliance
You are responsible for your own tax obligations. GST-registered partners must provide valid tax invoices where required. ListBetter may issue recipient-created tax invoices (RCTIs).
If you do not provide a valid ABN, ListBetter is required to withhold 47% tax under ATO rules.
Data Protection
You must handle all personal information received through the platform in accordance with the Australian Privacy Act 1988 and the Australian Privacy Principles. You must not share, use for unrelated marketing, or retain seller data beyond the engagement without consent.
Intellectual Property & Platform Misuse
You may use ListBetter’s name and approved logos solely to indicate your status as a Partner, subject to our brand guidelines. You must not modify trademarks, imply exclusive endorsement, or register domains containing “listbetter” or similar terms.
In addition to the intellectual property protections in these Terms, you are also bound by the Platform Terms of Use.
You must not, directly or indirectly:
Copy, replicate, recreate, or rebuild any platform features, workflows, logic, or automations
Create derivative works (including “inspired by” versions)
Use the platform or knowledge gained to build a competing service
Scrape, extract, or export platform data
Use the platform to train AI or create competing systems
These obligations survive termination. Breaches may result in immediate termination and enforcement action including liquidated damages of AUD $5,000 per breach (which the parties agree is a genuine pre-estimate of the loss ListBetter would suffer from such a breach, including development costs, lost revenue opportunities, and brand damage which are difficult to quantify precisely), plus full indemnity for legal costs.
Termination
Either party may terminate this Agreement with 30 days’ written notice.
ListBetter may terminate immediately for cause, including breach of noncircumvention, repeated complaints, licence/insurance lapse, or fraudulent activity.
Upon termination you must complete all current engagements and cease using ListBetter branding.
Liability & Indemnity
You are an independent contractor. You are solely responsible for the quality and delivery of your professional services.
You agree to indemnify and hold harmless ListBetter, its directors, employees, and affiliates from any claims, losses, or expenses (including legal costs) arising from your services, breach of this Agreement, or violation of professional standards.
To the maximum extent permitted by law, ListBetter’s liability is limited to the total lead fees paid by you in the 12 months preceding any claim. We are not liable for indirect or consequential losses.
Governing Law & Changes
This Agreement is governed by the laws of Queensland, Australia. Any disputes must be brought exclusively in the courts of Queensland. ListBetter may update these terms with 30 days’ notice. Continued participation after changes constitutes acceptance.
This Agreement, together with the ListBetter Platform Terms of Use and Privacy Policy, forms the entire agreement between the parties.
