These terms govern access to and use of the ListBetter website, apps and services by anyone.
ListBetter is a technology platform that connects property sellers with independent real estate agents using AI-powered matching and automated systems.
Connection service only — We do not sell property, act as an agent, or guarantee outcomes.
No warranties — The platform is provided “as is” and “as available”.
Your responsibility — Keep your account secure and use the platform lawfully.
IP protected — No copying, scraping, or building competing services. Breaches may attract liquidated damages of $25,000.
Governed by Queensland law.
By accessing or using the ListBetter platform (website, apps, or services), you agree to these Platform Terms of Use. If you do not agree, you must not use the platform.
Platform Nature
ListBetter provides a technology platform that facilitates connections between property sellers and independent real estate agents using automated systems and AI-powered workflows.
ListBetter is not:
A real estate agent or broker
A party to any property transaction
A negotiator or advisor
A provider of legal, financial, or professional advice
A guarantor of leads, proposals, sales, or any outcomes
The platform is a connection and automation service only. You use it at your own risk.
Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts. By using the platform, you represent and warrant that your use complies with all applicable laws.
Accounts
To access certain features, you must create an account. You are responsible for:
Keeping your login credentials secure
All activity that occurs under your account
Ensuring the information you provide is accurate and up to date
ListBetter is not responsible for any unauthorised access resulting from your failure to secure your account.
Acceptable Use
You agree not to:
Misuse or interfere with the platform or its systems
Attempt to bypass fees or security measures
Scrape, crawl, mirror, export, or extract data or content
Reverse engineer, decompile, or attempt to access underlying systems
Submit false, misleading, or infringing content
Abuse, harass, or harm other users (sellers or agents)
Use the platform for any unlawful purpose
Platform Control
ListBetter may at any time, with or without notice:
Add, remove, or modify features, workflows, or services
Change the user interface or matching logic
Introduce new tools or retire existing ones
Adjust availability or rules
No specific feature or outcome is guaranteed.
Suspension & Termination
ListBetter may suspend or terminate your access to the platform at any time, with or without notice, if you breach these Terms, misuse the platform, harm other users, or interfere with platform integrity.
You may stop using the platform at any time, but certain obligations (including IP, indemnity, and accrued fees) survive termination.
Intellectual Property & Platform Misuse
All content, technology, processes, AI systems, branding, designs, workflows, and materials on the platform are owned by or licensed exclusively to ListBetter Pty Ltd. You are granted only a limited, nonexclusive, revocable licence to use the platform for its intended purpose.
You must not, directly or indirectly:
Copy, replicate, recreate, or rebuild any platform features, workflows, logic, or automations
Create derivative works (including “inspired by” versions) or rebranded/modified versions
Use the platform or knowledge gained from it to build a competing product or service
Scrape, crawl, mirror, export, or extract platform content, structure, or data
Use the platform to train AI, create datasets, or generate competing logic or systems
These obligations survive termination and account deletion. Breaches may result in immediate termination and enforcement action, including liquidated damages of AUD $25,000 per breach plus full indemnity for legal costs.
User Content
If you submit any content (including property details, proposals, text, images, or data), you grant ListBetter a non-exclusive, worldwide, royalty-free, perpetual licence to use, display, store, process, and analyse that content for the purpose of operating and improving the platform.
You warrant that you have all necessary rights to submit such content and that it does not infringe any third-party rights.
Liability & Disclaimers
The platform is provided “as is” and “as available” without any warranties, express or implied.
To the maximum extent permitted by law, ListBetter is not liable for any loss of opportunity, revenue, profits, data, or any indirect or consequential loss. Our total liability to you is limited to the total fees you paid to us in the 3 months prior to the event giving rise to the claim (or $100 if no fees were paid).
You agree to indemnify ListBetter, its directors, employees, and affiliates against any claims, losses, or expenses (including legal costs) arising from your use of the platform, your content, or your breach of these Terms.
Force Majeure
ListBetter is not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, power failures, network outages, government actions, or third-party service failures.
Changes to These Terms
ListBetter may update these Platform Terms of Use from time to time. The updated version will be posted on our website. Your continued use of the platform after any changes constitutes acceptance of the revised Terms.
Governing Law
These Platform Terms of Use are governed by the laws of Queensland, Australia. Any disputes must be brought exclusively in the courts of Queensland.
General Terms
These Terms constitute the entire agreement between you and ListBetter regarding your use of the platform. If any provision is found invalid, the remaining provisions remain in effect. Our failure to enforce any right does not constitute a waiver.
